TERMS OF SERVICE — USER AGREEMENT

This document constitutes a public offer pursuant to Articles 633, 641, 642 of the Civil Code of Ukraine and the Law of Ukraine "On Electronic Commerce" No. 675-VIII. Registration or use of the service constitutes full and unconditional acceptance of all terms of this Agreement.

1. GENERAL PROVISIONS

1.1. 3Desher is an information marketplace platform facilitating interaction between buyers, 3D printing service providers, freelancers and other participants in the 3D printing market.
1.2. The Platform is NOT a party to transactions between buyers and sellers. The Platform provides a technical marketplace solely for the purpose of enabling such transactions.
1.3. Acceptance of this offer occurs upon: account registration; placing an order; listing a product, service or 3D model; or continued use of the site after publication of an updated Agreement.

2. DEFINITIONS

Platform — the 3Desher service (3desher.com), iOS/Android mobile apps and desktop application.
Administration — the party operating and managing the Platform.
Buyer — a registered USER-role user who places orders.
Seller — a SELLER/PRINTER-role user providing 3D printing services or selling goods.
Freelancer — a user who posts or completes tasks in the "Freelance" section.
Waybill (TTN) — a Nova Poshta transport waybill.
COD (Cash on Delivery) — payment upon parcel receipt.
Escrow — funds held by the Platform pending order completion confirmation.

3. REGISTRATION AND ACCOUNT

3.1. Full use of the Platform requires registration via email or Google OAuth.
3.2. Users must be at least 18 years of age to register.
3.3. Users must provide accurate information and are responsible for maintaining the confidentiality of their password.
3.4. Each person is entitled to one account without the express permission of the Administration.
3.5. The Administration may block or delete an account for violation of this Agreement or applicable law.

4. RULES FOR BUYERS
──────────────────────────────────────
4.1. Buyers may: browse the catalogue; place orders; use promo codes and the referral programme; leave reviews; contact support.
4.2. Buyers must: pay for orders promptly; provide accurate delivery details; collect parcels in a timely manner.
4.3. Order cancellation:
— Before Seller confirmation: cancellation without penalty;
— After confirmation and commencement of production: only by agreement with the Seller;
— After production is complete: may entail reimbursement of the Seller's actual costs.
4.4. Consumer rights are protected under the Law of Ukraine "On Consumer Protection" No. 3153-IX. For distance contracts, users must receive the full pre-contractual information required by law. Digital goods (3D models, files) are non-refundable after download unless a material quality defect is proven.
4.5. RETURNS, EXCHANGES, AND THE 14-DAY RIGHT OF WITHDRAWAL:
Under the Law of Ukraine "On Consumer Protection," a buyer may withdraw from goods purchased remotely within 14 calendar days from the date of receipt unless the nature of the goods or services clearly excludes such right.
4.6. A return of standard goods of proper quality is accepted only if all of the following conditions are met:
— the item has not been used;
— its marketable condition, consumer properties, seals, tags, and completeness have been preserved;
— the buyer can identify the order using the order number, email, or other account data;
— the request is submitted within the applicable time limit.
4.7. Exclusions from the ordinary 14-day return right include:
— digital goods (3D models, STL, 3MF, and other files) that have been downloaded or made available after payment;
— custom 3D printing services after production has actually started or after an individual technical brief has been approved;
— goods manufactured, modified, or personalized to the buyer's individual specifications;
— any other categories that are non-returnable under applicable law.
4.8. If a product is defective, damaged, incomplete, or materially inconsistent with its description, the buyer may request a refund, replacement, repair, or any other remedy available under applicable law. In such cases, the return costs are borne by the seller or other responsible party under marketplace rules and applicable law.
4.9. Basic return procedure:
— the buyer contacts [email protected] or another official support channel and provides the order number, the reason for the request, and, where possible, photo or video evidence;
— the seller or the administration provides instructions for return shipment and inspection;
— if the return concerns goods of proper quality, the buyer bears the return shipping costs unless the parties agree otherwise;
— the refund is initiated after receipt and inspection of the item within the period stated in the Returns Policy and required by applicable law.
4.10. Detailed return conditions, review timelines, exclusions, and the address for returns and written claims are also published on the separate "Returns Policy" page, which forms an integral part of this Agreement.

5. RULES FOR SELLERS
──────────────────────────────────────
5.1. Seller obligations:
— Provide accurate and complete information about goods and services;
— Fulfil accepted orders within agreed timeframes;
— Only sell lawful goods and services that do not infringe third-party rights;
— Pay all taxes and fees independently in accordance with Ukrainian law (the Platform is not a tax agent of the Seller);
— Comply with the Law of Ukraine "On Consumer Protection".
5.2. Sellers are prohibited from:
— Selling counterfeit, pirated or illegal goods;
— Misleading buyers regarding product characteristics, materials or timelines;
— Conducting transactions outside the Platform after initial contact through it;
— Artificially inflating ratings and reviews.
5.3. Seller liability:
Sellers bear full legal and financial liability for product/service quality, accuracy of descriptions, compliance with applicable law and payment of taxes. The Platform bears no liability for Seller conduct. In the event of violations, the Platform will assist in protecting affected parties and will provide available Seller information to law enforcement upon official request.
5.4. Platform commission:
For provision of the marketplace, the Platform retains a commission on each completed order. The applicable commission rate is displayed in the Seller's account dashboard.

6. RULES FOR FREELANCERS
──────────────────────────────────────
6.1. The "Freelance" section is intended for posting and completing tasks in 3D design, modelling and related services.
6.2. Performers must fulfil tasks within agreed timelines, respect intellectual property rights, and independently pay all taxes on remuneration received.
6.3. The agreement between a client and a performer is their private transaction. The Platform is not a party and bears no liability for non-performance.

7. TRADING IN 3D MODELS
──────────────────────────────────────
7.1. Sellers confirm authorship or the right to distribute all uploaded files.
7.2. Buyers receive rights in accordance with the licence specified by the Seller (personal or commercial use).
7.3. File downloads after payment are final. Refunds are only available upon proven material non-conformity of the file with its description.
7.4. It is prohibited to list models that are copies of copyright-protected works without authorisation; contain weapon components; contain violent or extremist content; or infringe trademarks.

8. EQUIPMENT MARKETPLACE

8.1. The "Equipment / Second-Hand" section enables buying and selling of 3D printers, filaments and related equipment between users.
8.2. The Platform does not verify equipment condition. The sale and purchase agreement is concluded directly between buyer and seller.
8.3. Sellers must accurately describe the condition of goods and must not conceal material defects.

9. PAYMENT AND SETTLEMENTS
──────────────────────────────────────
9.1. Payment methods:
— Online via LiqPay (Visa/Mastercard, Google Pay, Apple Pay);
— Cash on Delivery (COD) via Nova Poshta — cash payment upon receipt.
9.2. Escrow: when paying via LiqPay, funds are held by the Platform until order completion is confirmed and released to the Seller upon the order reaching "Completed" status.
9.3. COD: funds are transferred from Nova Poshta to the Platform's account and disbursed to the Seller after delivery confirmation. If a buyer refuses to collect a parcel, return shipping costs are agreed between the parties.
9.4. All prices are stated in Ukrainian hryvnia (UAH). The Platform is not a financial institution. Disputes regarding payment services must be directed to LiqPay or the card-issuing bank.

10. DELIVERY VIA NOVA POSHTA
──────────────────────────────────────
10.1. Nova Poshta is an independent third-party carrier. The waybill is generated through the Platform's account; the Seller physically hands over the parcel at their local branch.
10.2. Sellers must deliver the parcel to a Nova Poshta branch promptly and ensure adequate packaging.
10.3. The Platform bears no liability for delivery timeframes (complaints should be directed to Nova Poshta) or for damage to goods in transit.

11. PROHIBITED CONDUCT
──────────────────────────────────────
The following are strictly prohibited on the Platform:
— Content supporting armed aggression against Ukraine; promotion of the aggressor state's symbols;
— Sale of weapons, ammunition, narcotics, counterfeit medicines or other prohibited goods;
— Fraud, deception, mass registration of fake accounts;
— Abuse of the referral programme or promo codes;
— Hacking, unauthorised access, automated scraping, DDoS attacks;
— Distribution of child sexual abuse material (CSAM).
Violations result in immediate account suspension, content removal and referral of data to law enforcement.

12. LIMITATION OF PLATFORM LIABILITY
──────────────────────────────────────
12.1. The Platform acts as an information intermediary pursuant to Article 15 of the Law of Ukraine "On Electronic Commerce".
12.2. To the extent permitted by Ukrainian law, the Platform is not liable for the quality of Sellers' goods or services, acts of independent third parties (including Nova Poshta, LiqPay and authentication providers), temporary unavailability caused by circumstances beyond the Platform's reasonable control, or decisions Users make on the basis of content posted by others.
12.3. Unless mandatory law provides otherwise, the Platform's aggregate contractual liability is limited to commissions actually paid by the relevant User during the three months preceding the claim. This limitation does not apply where liability cannot lawfully be limited by contract.
12.4. Users are responsible for keeping passwords and verification codes confidential, securing access to their email accounts and devices, keeping contact details accurate, and for activity performed through their account until the Platform is notified of compromise. Credentials must not be shared. A User who suspects unauthorised access must immediately change the password and contact support.
12.5. The Platform applies reasonable organisational and technical safeguards against accidental loss or destruction, unlawful processing and unauthorised access in accordance with Article 24 of the Law of Ukraine "On Personal Data Protection". No information system can guarantee absolute security. The Platform is not liable for an incident caused exclusively by the User, malware on the User's device, or unlawful acts of a third party where the Platform has complied with its statutory security duties. This clause does not exclude liability for the Platform's own culpable breach of mandatory law.

13. DISCLOSURE TO LAW ENFORCEMENT
──────────────────────────────────────
13.1. The Administration discloses personal data on the basis of lawful requests from pre-trial investigation authorities, prosecution, court orders or CERT-UA requests.
13.2. Upon detecting violations, the Platform: immediately suspends the account; preserves data (IP addresses, transactions, waybills, correspondence) until proceedings are concluded; and discloses data to law enforcement upon a proper request.
13.3. The Administration may independently report detected offences to law enforcement without waiting for a formal request.

14. INTELLECTUAL PROPERTY
──────────────────────────────────────
14.1. Original texts, source code, graphics, photographs, video, logos, visual assets, the selection and arrangement of databases, and other original works owned by 3Desher are protected by the Civil Code of Ukraine, the Law of Ukraine "On Copyright and Related Rights" No. 2811-IX, and other applicable law. The "3Desher" designation and other brand elements are protected to the extent of acquired trademark and trade-name rights.
14.2. Ideas, principles, methods, processes, systems and concepts as such are not protected by copyright under Article 8 of Law No. 2811-IX. Users may not copy or reproduce the Platform's specific protected implementation without permission, including its source code, texts, graphics, original content, databases, photographs, video and other protected material, or use branding in a manner likely to cause confusion with 3Desher.
14.3. Prohibited conduct includes decompilation except where expressly permitted by law, circumvention of technical protection, mass automated copying, creation of a derivative service through unlawful use of protected materials or databases, removal of authorship notices, and use of Platform content to mislead users. A breach may result in access suspension, content removal, demands to cease infringement, recovery of proven damages, and other remedies available by law.
14.4. By posting content, the User confirms ownership or authorisation and grants the Platform a non-exclusive, royalty-free licence to store, technically reproduce, display and distribute that content only to the extent necessary to operate, promote and protect the service, for the posting period and any technically necessary backup-retention period.
14.5. An infringement notice must identify the rights holder, describe the protected work, identify the disputed material, provide evidence of rights, and include the claimant's contact details. The Platform reviews properly substantiated notices and takes action in accordance with the Law of Ukraine "On Electronic Commerce" and other applicable law.
14.6. By accepting this Public Offer, the User gives informed consent to processing personal data necessary for registration, authentication, placing and performing orders, payments, delivery, returns, support, fraud prevention and compliance with law. This may include name, email, telephone number, delivery addresses and identifiers, order and payment history, support communications, IP address, User-Agent, cookies and security logs.
14.7. Data is disclosed only as necessary to the relevant Sellers, payment institutions, delivery operators, infrastructure and authentication providers, professional advisers and public authorities where a lawful basis exists. Personal data is not sold for third-party advertising.
14.8. Data is retained only for as long as necessary for the stated purposes, performance of contracts, accounting and tax requirements, limitation periods, dispute resolution and fraud prevention. It is then deleted or anonymised unless retention is required by law.
14.9. Users may request information and access, correction or erasure where provided by law, withdraw consent where processing relies specifically on consent, and complain to the Ukrainian Parliament Commissioner for Human Rights. Withdrawal does not affect prior lawful processing or processing required to perform a contract or comply with law.
14.10. Acceptance evidence is recorded with the document version, date and time, user or session identifier, IP address, User-Agent and a checksum of the accepted text. This information is used solely for security and evidence that the electronic contract was concluded.
14.11. Strictly necessary cookies are used for authentication, carts, security, language and order performance. Analytics, personalisation and advertising cookies, if used, are enabled only after a separate User choice and may be disabled without losing core functions.
14.12. Consent to advertising email, SMS, push messages or personalised advertising is voluntary, separate from acceptance of this Offer, is not preselected and may be withdrawn. Security, order, payment and delivery messages are service communications rather than advertising.
14.13. Users may request access, a machine-readable copy, correction, restriction or deletion through their account or support. The Platform may verify the requester’s identity. Deletion may be deferred for records required by law, unfinished contracts, fraud prevention or legal claims.
14.14. Following a security incident, the Platform restricts access, preserves technical evidence, assesses risk, remediates consequences and provides notifications required by law. Security logs, IP addresses, User-Agent data, acceptance evidence and administrative audit records are accessible only to authorised administrators and persons requiring access by law.
14.15. Independent use of the Platform and conclusion of contracts is intended for adults with legal capacity. A minor may use the service only within their legal capacity and, where required, with consent of a legal representative.
14.16. Sellers confirm that registration, tax, banking and contact details are accurate and lawful, that they hold rights to goods, models and content, and that they remain responsible for applicable taxes, licences, warranties and consumer information.
14.17. An advertiser or User creating or purchasing advertising is responsible for its accuracy and legality, rights to advertising materials, mandatory labels and compliance with the Law of Ukraine "On Advertising". The Platform may review, reject, suspend or remove advertising, but moderation is not a guarantee of a product or advertising claim. To the extent permitted by law, the Platform is not liable for third-party advertising content or decisions based on it; this does not exclude liability for the Platform's own culpable breach of mandatory requirements.

15. REFERRAL PROGRAMME
──────────────────────────────────────
15.1. Bonuses are accrued only for genuine registration of a new unique User. Self-referrals and fake accounts are prohibited.
15.2. Detection of abuse results in cancellation of bonuses and account suspension without compensation.

16. DISPUTE RESOLUTION
──────────────────────────────────────
16.1. Before initiating legal proceedings, Users must submit a written complaint to the Administration. The Administration will respond within 14 calendar days.
16.2. Disputes are governed by the laws of Ukraine. Consumer buyers may also contact the State Service of Ukraine on Food Safety and Consumer Protection or bring a claim in the court at their place of residence.

17. AMENDMENTS
──────────────────────────────────────
17.1. The Administration notifies Users of material changes via a site banner or email no less than 7 days before the changes take effect.
17.2. Continued use of the Platform after changes take effect constitutes acceptance of the new version.

OFF-PLATFORM DEALS AND COMMUNICATION
A Seller, Freelancer or other User contacted through 3Desher must not persuade or instruct another User to move an order, payment or project outside the Platform, request cash or a transfer to personal payment details in order to bypass Platform procedures, or move transaction-related communication to a private messenger for that purpose. Contact details may be exchanged only when reasonably necessary to perform an order already recorded on the Platform.
A User receiving such a proposal should not pay and should report it through the official support or reporting channel. The Platform may preserve relevant messages and security logs, request an explanation, restrict transaction features, suspend or terminate an account, remove listings or content, and cancel privileges after reviewing the circumstances. Measures are proportionate to the violation; urgent temporary suspension may be applied where necessary to protect Users or evidence.
Account termination does not mean immediate erasure of every record. The Platform may retain order, acceptance, correspondence, security, fraud-prevention and other evidence for periods required by law, dispute resolution or protection of legitimate interests. Information is disclosed to law enforcement, a court or another competent authority only on a lawful basis. The Platform may pursue remedies available by law where a violation causes loss or contains signs of an offence.
PAYOUT DETAILS AND IBAN RESPONSIBILITY
The Seller must independently verify that the recipient name, IBAN and other payout details entered in the account are complete, current and correct before confirming them or requesting a payout. A payout instruction is formed using the details confirmed by the Seller.
To the extent permitted by applicable law, the Platform is not responsible for funds transferred to an incorrect or third-party account where the transfer was executed using inaccurate details entered or confirmed by the Seller. The Seller bears the consequences and reasonable recovery costs caused by such inaccurate details. This clause does not exclude the Platform's responsibility for its own technical error, unauthorised alteration of confirmed details attributable to the Platform, or liability that cannot lawfully be limited. The Seller must immediately notify support after discovering an error; the Platform may assist with a recovery request but cannot guarantee return of funds already credited or processed by a payment provider or bank.

GENERAL RULES
Returns are governed by the Law of Ukraine 'On Consumer Rights Protection'.
STANDARD (OFF-THE-SHELF) GOODS
Buyers may return goods of proper quality within 14 calendar days of receipt,
provided the item has not been used and retains its appearance, consumer properties, seals, and packaging.
Return shipping costs are borne by the buyer unless the return is due to a product defect.
MADE-TO-ORDER GOODS (3D printing, custom items)
Under Article 9 of the Law of Ukraine 'On Consumer Rights Protection', goods manufactured
to the buyer's individual specification that cannot be resold to another person are not
eligible for return, except where a manufacturing defect is discovered.
If a defect is found — replacement or refund at the seller's expense within the warranty period.
RETURN PROCEDURE
1. Contact 3Desher support using the official channels listed on the site.
2. State your order number and describe the reason for return.
3. After confirmation, send the item to the return address provided by support or the seller in the case response.
4. Refunds are processed within 7 business days of receiving and inspecting the item.

How delivery, LiqPay, cash-on-delivery, shipping timelines and the main order-payment terms work.
DELIVERY
Orders are delivered across Ukraine via Nova Poshta.
Delivery times:
— major cities: 1–2 business days;
— regional centres and villages: 2–4 business days.
Delivery cost is calculated according to Nova Poshta rates and displayed at checkout.
PAYMENT
Payment is processed online via LiqPay (Privatbank).
Visa, Mastercard, Apple Pay and Google Pay are supported.
Funds are held on the buyer's card immediately upon order confirmation.
The seller receives funds after confirming order fulfilment.
Payment gateway fees are included in the price and not charged separately.

This Privacy Policy is governed by the Law of Ukraine "On Personal Data Protection" No. 2297-VI of 01.06.2010, as amended. By registering or using the 3Desher service, you acknowledge that you have read this Policy and consent to the processing of personal data for the purposes stated herein.

— IP address;
— Browser type and operating system;
— Cookies and session identifiers;
— Access logs;
— Device data (in the mobile app);
— Firebase FCM token (for push notifications).
2.3. Transaction data:
— Order information (items, amounts, statuses);
— Delivery data (waybill number, tracking status);
— Payment transaction identifiers (card details are processed exclusively by LiqPay, not stored by us).
2.4. We do NOT store full card numbers, CVV/CVC codes or payment system passwords.

a) Service delivery: registration, authentication, order processing and fulfilment, delivery coordination, payment processing, notifications;
b) Security: user verification, fraud detection and prevention, protection against unauthorised access;
c) Support: responding to enquiries, technical communications, change notifications;
d) Analytics: aggregate analysis of service usage (without identifying specific individuals);
e) Legal compliance: data retention and disclosure as required by law.

5. SHARING DATA WITH THIRD PARTIES

5.1. We share data with the following categories of third parties:
NOVA POSHTA (novaposhta.ua)
Purpose: delivery organisation, waybill creation.
Data: Buyer's name, phone number, delivery address.
LIQPAY / PRIVATBANK (liqpay.ua)
Purpose: payment processing.
Data: order amount, order ID, email address.
GOOGLE / FIREBASE
Purpose: OAuth authentication, push notifications.
Data: email and name (when signing in via Google), FCM device token.
LAW ENFORCEMENT AUTHORITIES
Purpose: fulfilment of legal requirements.
Data: any data pursuant to a lawful request (Article 14, Law of Ukraine "On Personal Data Protection").
5.2. We do not sell, rent or exchange personal data with advertising agencies or data brokers.

6. DATA RETENTION PERIODS

— Account data: until account deletion + 30 days (backup copies).
— Transaction and order data: 5 years (accounting legislation requirements).
— Access logs: 12 months.
— Data related to violation investigations: until proceedings are concluded.

7. DATA SECURITY

— Data in transit: TLS 1.2/1.3 (HTTPS).
— Passwords: bcrypt hashing (original passwords are never stored).
— Sessions: HttpOnly, Secure cookies, SameSite=Lax.
— Database access: restricted to authorised personnel.
— Backups: regular encrypted backups.
No security system is absolutely impenetrable. In the event of a data breach that may cause significant harm, we will notify affected Users and the relevant supervisory authority within the timeframes prescribed by law.

8. YOUR RIGHTS

Under Article 8 of the Law of Ukraine "On Personal Data Protection" you have the right to:
ACCESS — request a copy of your personal data.
RECTIFICATION — request correction of inaccurate or outdated data.
ERASURE — request deletion of your data (subject to lawful grounds for retention).
RESTRICTION — request restriction of processing in cases provided by law.
OBJECTION — object to processing on the basis of legitimate interest.
